INTERORGANIZATIONAL RELATIONS/POLICE DEPARTMENT INTERROGATIONS AND
INVESTIGATIONS
While the Board believes that the district and police authorities have
certain interests in common which may best be served by cooperation,
the Board also has an obligation to protect the civil rights of the
students who are in its charge.
The following guidelines shall be observed:
-
Students may be
interrogated by law enforcement authorities during school hours and
on school property according to the following guidelines:
- when the purpose is to question or interrogate
a suspect to a felony or misdemeanor, either the parent shall be
present or the parent shall have given consent to a school
official (teacher, counselor, or administrator) being present;
- when the purpose is to question a student not a
suspect to a crime, the parents may be notified, but a school
official shall be present regardless of parental notification; and
- when the purpose is to conduct a search and
seizure, the procedures contained in the "Uniform Code of
Discipline and Students' Rights and Responsibilities" handbook
shall govern, along with Board policies.
- When students are arrested and removed from the
