SMOKING IN SCHOOL FACILITIES
To ensure the highest standards of learning as well as the safety, health, and well-being of students and employees the Benton Harbor Area School District enforces Enrolled Senate Bill 459, the Tobacco-Free Schools Law with a policy which will: aid students and employees to abstain from use of all tobacco products; intervene early when use is detected; take corrective disciplinary action when necessary; and make accessible aftercare support for students. The Board declares that Tobacco use is prohibited from all public school grounds, facilities and vehicles until after 6:00 p.m. on school days.

The Benton Harbor Area School District will provide staff and students with information and activities focused on preventing the use of tobacco products.  Prevention activities will be centered around the student instructional programs, staff inservice training, staff and student assistance programs, school climate and family and community development.

The Benton Harbor Area School District shall establish and maintain an assistance program and provide resources to aid staff and students who currently use tobacco products to successfully address this harmful involvement and eliminate this behavior.

Staff and students have a right to work in or to attend school in an environment free of second hand smoke.  The district has the responsibility to enforce compliance with the law by prohibiting the use of any tobacco product on all school/district property.  The Benton Harbor School District will be in compliance with the legal requirements and acknowledge their health responsibility to:  provide a healthier environment in which students can learn and staff can work; limit the possibility of students seeing adult role models smoke; work cooperatively with all Local Law Enforcement Agencies:  and to promote healthier behaviors among staff and students.

The Board shall delegate to the Superintendent or designee the authority to devise a plan that shall provide for the implementation of this policy.

These rules and regulations shall be reviewed and adopted by the Board.
