SCHOOL BOARD AUTHORITY
As school
boards are the creation of the State of Michigan Legislature, their
authority is a delegated one. They may perform only those acts for
which authority has been delegated them by the state legislature. This
authority may be expressly stated or implied in state statutes; it may
be established through directives of the State Department of Education
which serves to implement school laws, or court rulings which clarify
them. A board has no inherent authority or rights arising out of its
local composition, election, or domain of operations.
The
powers delegated to a school board by the State are delegated to the
board as a body. No authority is granted board members acting as
individuals.
